Amazon has lot of shady and fake sellers. I have bought all my AirPods/Beats buds from Costco. Returned my beats buds when they had crackling sound issue after 6-7 months. I bought another one, those red beats buds are still going strong. Costco does take returns for AirPods/beats after 90 days, just need a manager override if you have issues. Let Costco deal with apple.
 
Verizon has them for $199 as well, if you don't want to deal with Amazon.

Handy if you happen to have promotional credit from using FiOS or their wireless service. (I had a $50 Verizon gift card credit kicking around, so got a pair AirPods Pro for net $150 + tax, which is pretty damn good).

Yes. I've returned two sets of AirPods and a set of B+W Pi7's due to quality issues. It appears all three times, they were used and returned where Amazon accepted them as not opened when they needed to be inspected and refurbished. This is what an AppleCare check kicked back on a pair I bought last week off Amazon that were listed as "New". They had microphone issues and my calls sounded muted to others.

In my experience yes it's a thing, in particular the hinge mechanism.

I purchased my gen 1 AirPods Pro maybe a month or two after they went on sale and the hinge was completely rock solid, no wiggle whatsoever, great sound when you close the lid (pleasant deep SNAP), and absolutely zero creaking when you handle the case in your hand.

Meanwhile, I received a first batch pair of APP gen 2. Creaky lid, super wobbly, disgusting tinny sound when you snap it shut, and overall the plastic didn't feel right. I had them exchanged at the Apple Store a week later. My replacement unit was better but still nowhere near as solid as my gen 1.

MR readers gaslit me into thinking there wasn't a problem with the gen 2 first batch and that worrying about hinge quality (like the sound it makes when you close it) is ridiculous but people on reddit coming from gen 1 also posted about the exact same quality issues.

Until it's sold (and shipped) by Amazon.com, it's good and no worries.
I used to believe this, until I purchased an Apple Lightning Cable directly from amazon.com and it arrived with slightly different plug housing dimension and my iPhone started saying the cable was not a compatible cable. This happened twice.

And then I looked into it and found it wasn't uncommon. Here's a Forbes article that explains how it happens.

All those products often get pooled together by bar code, regardless of whether they come from the brands themselves or other distributors. That way, Amazon can grab whichever product that’s ordered at the nearest warehouse to the customer.

That means even if you buy something that is technically sold by Amazon under the brand’s name, you might end up with a product supplied by a third-party merchant, which may or may not be the real thing.
 
There are no "second tier" AirPods out there that are made by Apple. What you could get is a knock-off, though. That's a thing.

I have genuine AirPods Pro and I picked up knock-offs for less than $20. Amazingly, the phone treats them the same as the real ones. Opening the case invokes the little pop-up screen and everything. The downside is they sound like total crap. Even for $20 they sound like crap.

Just choose Amazon or a known seller and you'll be fine. Buy it from xxx3t then that's on you.
