well im considering going into my local apple store pretty soon since i have a defective 2g ipod touch. My question is can i ask them to refund me my money (instead of a replacement) even though i bought it in October 2008?

I hope this thread is a joke.
If not, no, you can't. No retail store I know has over a 90 day return policy. Certainly not 9 month one.

what i mean is instead of them giving you a replacement unit, can u just claim that you are unhappy with your ipod experience and would appreciate it if you could just get a refund

No. If you were within the return policy window? Absolutely. I can go to Target and buy something and 89 days later with a receipt say "I hate this thing, gimme my money" and they have to do it.

91 days later with a receipt? Nope.

ok so the only thing i can possibly do is obtain a brand new replacement at the apple store when i go to a genius bar appointment
also, are the ipod headphones covered under the 1 year warranty?

Everything in the box is covered under the 1 year warranty unless it is physically damaged or water damaged. Yes, you can get it replaced.
