Apple has available replacements units strictly for defects that they set aside for these types of issues. Rather how many devices they actually have available for replacement is variable. Most stores also carry replacement units as well.
 
Depends what you mean, if it's something actually defective (won't turn on, screen is blank, no audio etc) then obviously.

I'm not one of those wankers who will return a device because the screen is slightly yellow or something though.
