I thought it was just me! I have the same issue with the Apple clear case on my iPhone 13 Pro Max. I’m taking it back to the Apple Store tomorrow to swap it out…

Arg, I am planning to do the same. But my guess is it’s a design flaw of the case. If it is then I’m wondering what they’ll do about it.
 
I have an Apple MagSafe clear case on my 13 Pro (not Max) and it fits fine. The fit seems to be the same as it was with my 12 Pro clear case on my 12 Pro.

Update: I exchanged my iPhone 13 Pro Max clear case at the local Apple Store. The replacement is the same :/
I was afraid of that. Now I’m wondering what they’ll do. The creaking noise pretty annoying.
First I suppose they need to be made aware of it. If it’s a systemic problem they should eventually do something since even the cases are under a very limited warranty.
 
Same issue here on the 13 Pro, two replacements, still the creaking noise.
 
I ended up returning the new clear case and got an Abyss Blue silicone case instead. I then ordered this case from Benks which is the closest in look and feel to the OEM clear case but includes bottom coverage and metal buttons:

 
With how bad the XR clear case was, I wouldn't buy one again for any newer phone. Case cracked at the bottom just from removing it and Apple support wouldn't even consider replacing it under warranty considering how many other people had the exact same issue.
 
Yes I did! I took it to the Apple store and swapped it for a leather one. The guy looked at me like I was crazy but it was very noticeable and annoying!!
 
So everyone has some play between the phone and case at the bottom corner? People have said the case was extremely tight in the past.
 
Correct, last year case was very tight causing some cracks to appear after couple of months

I guess they went the other direction this year to try to avoid that. I suppose that’s better than cracking, but it’s pretty annoying to feel the phone constantly moving around in the case.

So your phone doesn’t move around in the case at the bottom? Mine is firm at the top and even the bottom right, but it has a lot of play in the bottom left side of the case.
 
Just noticed the same thing on mine, bottom left feels loose and creaks. Did you end up returning yours? I quite like the clear case but it's a bit annoying.
No I didn’t return it. I figured it’s going to be the same for all of the clear cases designed by them :(

I ended up returning mine yesterday. It just annoyed me too much feeling the phone shift every time I touched the bottom left corner. It’s definitely a better trade off than having the corners crack, but I can’t tolerate either issue.
 
I'm having the same issue with 13 Pro Max - loose at the bottom and constantly moving slightly. I thought I was get used to it but it just never stops.

Does anyone tried putting something to fill the loose space with something?

I tried. I finally decided it was just too annoying for me. I returned and got a leather case.
