Hi, I bought on iPhone 5s 16gb from best buy on Friday for $261. The tax was insane....anyways, I've had the phone for 3 days and already need more storage, so I was wondering if I return this to best buy and buy a 32gb from the apple store will the tax be 8% of $299 or 8% of $750?

Just trying to see if it's ANY cheaper to buy from apple. Thanks

i know it's redic. here in california the tax is run off the of the unsubsidized price, and not the sale price.

If you bought your device from Best Buy you are definitely over paying Sales Tax in the state of CA. There are a couple other threads in the forum going over this. Additionally they are not charging 8% on $649 but on $699.99 as they charge an additional $50.99 above everyone else for an unsubsidized device and in all likelihood you may be being charged 10.018% rather then 8% that you should be. I'd check the receipt if I were you as it would likely be cheaper to get it from a different place. Just remember you only have 3 days to return it in order to get your upgrade eligibility back in most cases.

Get it from Walmart. I am not sure you will get from WM the 32 GM or greater but WM charges tax only on subsidized price.

Walmart doesn't create tax laws, the collect sales tax according to the state they are located in. If the store is in CA, they collect sales tax on the unsubsidized price.

I believe California, Massachusetts, and Rhode Island are the states that require sales tax to be calculated on the full, unsubsidized value of the phone.

I can confirm that the Apple Store only charges tax on the subsidized price in Nevada. However, an AT&T store will charge tax on the full price (it could be standard practice for them). You could always use a road trip to Las Vegas!
