Did you try the obvious?
Deactivate the Dropbox sync in Notability, remove the Notability folder from Dropbox, relaunch Notability, reactivate and reconfigure the sync in Notability.

??? that seems like it will sync the empty folder in notability to my dropbox.

I have notability on a fresh install of iphone5S, nothin in it. I have my old notability notes in dropbox that i want on my iphone 5s.

As far as I can tell, Notability doesn't really sync with Dropbox. It provides a one-way backup of notes to DropBox but uses iCloud for actual sync. Also, when I try to do DropBox backup on two iOS devices, I get a warning that it can be used on only one. So, I think what you are trying to do isn't possible. You probably have to add the files back manually. Are your files in iCloud, as well? If so, that would be where you go for restoring. I'd contact the developer about your problem.

i didnt do an icloud backup of my phone but i mite hav turned icloud on in the app. how would i go about adding the files back manually? I want to continue editing them in notability.

all i want is to get the stupid notes i had on notability/my dropbox and put them back in so i can continue workin on them and vice versa.

Right now im tryin to get them off my phone (which gingerlabs doesnt have a clear explanation of how to do) onto my mac, so i can copy them back into a new install. (what i did was i used ifunbox to transfer the old app data to the current install of it, which used to work cleanly in the past, but since ios 9.3 it no longer works perfectly and the functionality of the app is messed. So now im lookin for a way to at least manually take those notes in there back to my mac, and then copy them back to notability after i reinstall the app.)
