early (2008)mbp shuts down when battery goes lower than 76% charged

My MacBook Pro shuts down instantly when the bettery level goes lower than 76%. It does this on my Windows and OSX side. any ideas?

I've heard of this happening before with bad batteries.

your battery is probably defective, go to Apple and get it replaced! 🙂

I will have to buy a battery because my warranty is out.

This happened to me, I took it to the apple store and they told me it was a defective battery. They replaced it then and there and the problems been fixed ever since.
