I recently sold my iPhone 3G to lexus_lover on ebay http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=320510443747&ssPageName=STRK:MESOX:IT

Lexus_Lover paid me instantly, I was kind enought to add a second silicone cover to package for free since I didnt need it. I cleaned the phone very nicely and removed normal dust on the speaker/mic/usb connector area, sent him a brand new mic/heaphones used twice, and a old USB cable that I found, the auction didnt include a usb cable. The phone didn't had ANY scratches at all.

I shipped the phone and when he got it, he went directly to paypal to do a chargeback asking for a refund of $50 claiming that the rear cover had a crack were the usb cable connects, he told me that I forgot to mention this on my auction and that this was a problem on 3G and 3GS phones, as soon he explained me that that was a normal problem on the iphones, I knew this guy was trying to pull a fast one on me, I asked him for a picture of the rear cover, he sent me a picture of an iphone very blurry, I told him to send me the phone and I will refund his money back.

I took my video camera and recorded the day I received the package, I have been scammed before, one guy sent me a empty envelope with confirmation# and paypal gave him his money because the package was returned to me. This time I got my video camera and recorded everything, when I saw the mailman with a box, I said cool he sent me the phone, but I recorded all the steps anyway.

He returned me the iphone, some OLD BEAT UP headphones not the ones that I sent him, he kept the 2 silicone covers one pink and one black, and the phone had a crack on the rear cover, but the rear cover was defitly NOT mine, the phone that I sent had NO MARKS on the rear cover, the cover that he sent me had a few marks on the SIM card push hole, on the mic hole had 2 marks and the crack had dust in between line, in other words the crack didn't happend recently, it was an old crack and not my rear black cover.

I contacted paypal and ebay to tell them the problem that I had, and then started to look at his feedback, he left neutral feedbacks to several people that he returned the phone, I contacted all of this people and all of them responded me with the same story. "I sold him a perfect phone and he claimed is was broken, and when I got the phone back, he sent me a different old usb cable, broken cover, etc."

I contacted paypal with the new info, the other people never fight this with paypal because they didn't know what to do, all of this persons had very little feedback and that's the persons Lexus_lover was targeting to get their phones replace parts and the return them. I have more than 200 feedbacks and I think he choose me because I have a business name and maybe he thought that was easier to scam a company that wouldnt notice this after a few days etc.

Right now he is under investigation and paypal asked me to file a police report or fill an afidavit so they can go foward, they told me he had filed chargebacks like crazy with the same bogus claims of damaged goods etc, I tried to gave him the oportunity to come clean but, I'm sorry for him.

All the other sellers that had experience something similar with him will be contacting paypal soon so they can also file a police report, paypal told me that as soon they get the police report from me or affidavit, they will ask me to send the iphone to them and they will refund me my money, I'm guessing they need my iphone to investigate more deeply.

Lexus_Lover if you reading this you better start packing, I hope you used gloves when exchanging the cover, because it will be nice if they find your finger prints inside the phone or on the other side of the black cover. :rolleyes:
 
The sad thing about this is the other people he rip off, they had to buy a new cover to sell the phone again, loosing money on the process. original covers are expensive and it will affect your sale on ebay if you sell an iphone with a broken cover, he has bought several iphones after me, and I already contacted all of the sellers to be prepare if he claims something similar.

He's lucky that he's in the other side of the country, if this was locally uff, lets just say I will had my money back long time ago.

The stupid thing is, you can't give negative feedback as seller now on eBay. If the first person he did this to was able to neg him, that would have been fair warning to all other sellers.

Did you happen to take a pic or write down the serial number off the back of your original iPhone?

The picture that I have is difficult to see, and it doesnt have the serial number on the back only Model#, FCC number.

The IC ID# on the back of the cover doesn't match at all to the ICCID that appears on the General/About area and I'm sure it doesnt need to right?

I hate stuff like this

I had a guy all angry with me when I sold a perc i5 scsi card, and it was sealed and new in the package. The dell model number said it included a batter backup. I assumed my item with the same model and product number would also.

The guy whom bought the card knew that It did not come with the battery backup. Was obvious he was complaining about it. (and in my post I never said it came with one, but the dell page I linked to did.) In the end I had to refund him half of his payment to make him happy, and not leave negative feedback. Paypal did nothing. He got something that was worth $500 new for $40 (My employer had it sitting in his office for a few years never used it.)

Yet again your situation is much much worse. I hope it works out in your favor!
 
damn thats sad...i hope you sort out everything soon and get your money back..
thats why i don't like ebay...you can trust only reputable sellers...and i will never sell a thing on ebay...craigslist rules...

I've got to agree with MisterEdF here. PayPal are useless.

I got scammed on eBay with a member with an apparent glowing 100% Feedback.

I was done out of £170 after a seller scammed a load of people out of money, they managed to recover £105 from the scammers account and then charged me £20 for the pleasure of doing so leaving me £85 down.

This was in 2006 and the current status of the claim is:
Status
We were able to recover £105.00 GBP from the seller and processed a refund to you.

What happens next
We're working with the seller to recover the rest of your refund. We'll let you know when the seller is able to full refund your payment.
Absolutely useless. Hopefully they are better now but I doubt it.

So you think that he took apart the phone and put a different case back on, and specifically the back case?

If he did, then the assumption is that he tried to scam you for $50 and because he was unsuccessful, he took apart the phone and replaced the part in question, which is the back cover of the phone?

Do you have proof that the phone prior to delivery was not in the same shape that it is currently in?

Do you think he would go through the trouble of taking apart the phone and put another case on for $50? And if you want proof that he did take apart the phone, can't Apple detect if the phone has been taken apart?

As for your other assumption:

Wouldn't it make more sense to scam someone that's new to eBay and is an individual? If you're new, you probably wouldn't know what to do, and if you're an individual, chances are you don't have the financial resources and perhaps the time to pursue this very far.
 
For what I can see he buys and resells a lot of iPhones on ebay, and so far the only people he have returned the phones back are people with low feedbacks, that may not know how to defend themself on ebay, Im not the only one who had experience something similar with this buyer, there are at least 3 more people that contacted me about the same situation. He also screw things off by not sending me the 2 covers that I included and by sending me a damaged, dirty, broken cord headphones. I also have the original picture with more resolution the same one I used on ebay taken with my iphone 3GS wich includes the date recorded on the properties of the picture and on the picture you dont see any crack.

Also he only spend $13 on priority mail for shipping the phone back to me, but he kept a good conditions $50-$70 OEM back cover, 2 silicone covers $15.00 each (they were not crappy ebay ones), and he also kept a almost brand new OEM mic/headphones that arent cheap either.

I hate people that have like 100% feedback than when you buy something they don't ship it out and you see they scammed like 30 other people for money! I bought the Jesse Ventura conspiracy book and got scammed! I hate that his feedback is down to 23% instead of 100. I hate scammers.
 
Oh, never mind, I understand.. this has nothing to do with MacRumors per se, just a public service announcement of sorts..
