Trademark and copyright law is even more of a tangled weave of subtlety and interpretation than patent law. I fear this won't be the last we hear of this story.. it will drag on...

I have a slight feeling this guy trademarked "iWatch" in Europe knowing Apple is going to release an Apple watch some time in the future. He's just browsing 'options' for an iWatch to make it seem like a legitimate trademark registration that will be used. In the meantime, he's waiting for Apple to pay him a large sum so that they can get hold of that trademark. Just a theory.

Well, they have the name. And if some crowd in China want to offer them a suitcase full of cash - why not?

It happened with the iTouch name and people got over it and moved on with their lives.

Apple has smarten up this time. Just attach the brand name Apple to any word and it instantly becomes a registered trademark. The snafu with "iPad" in China may have left them a scar. So now every new product is Apple: Apple Pay, Apple Watch. Zero leaks, zero trademark issue.

Not paired

If they can make a watch stand on its own and NOT need the phone to be near, I'll buy it. The reason to have the watch is to do away from always having to have this other thing in your pocket-which frankly does not look good and is having to be dragged out painfully while sitting. Make an accessory like a belt buckle or shoe that carries extra functionality if needed. But basically we just need to make a call and see an email with a couple cool apps like the weather, maps etc. on there too.

and how many android users will want to buy a smart watch from a company they have never heard of, with the product name that implies it is an apple device?

Honestly, if you got protection for any i-[electronic device] name after the iPod was famous you should have that protection taken away.

Right, like when Microsoft issued all those law suites against anyone that used their protected "ie" (id est) in their advertising, claiming it infringed on Internet Explorer. It didn't work very well.

The more the merrier - competition is great and it helps products advance. But if it's a copycat, then I have no respect for the inventor.
Problem is, it takes years to bring a good solid product to market. But they are going to have a difficult time competing because of apple pay - I've already returned my iPhone 6 because it was too large for my daily use ( i really wanted it) so I am depending on the I watch to deliver apple pay to my iPhone 5s and I suspect many people have the same idea.

PS.. Apple, if you are listening; Please develop put the bells and whistles into a 5s size phone. Runners, mountain bikers, and many outdoor enthusiasts are opting out of the 6 product line due to it's size.
Actually, I know many people who brought back the 6 line - we love the sixes, but we would love to have a 6S with an m8. The camera is not a big deal, but the m8 appeals to outdoor enthusiasts who enjoy looking at their data at the end of the day and we don't know why.. It's just interesting.

We have been contacted by some very important manufacturers in China about the possibility of manufacturing a smartwatch and selling them with the name iWatch.

Yes, they already have the name -- that's the hard part. Now all they need is a product to go with it. Piece of cake.
