Exchanging an iPhone as Verizon

So long story short, my father in law bought a new 6S 16Gb at Verizon yesterday and turned in his 5s. Brings it home, restores, adds a few things and is out of space. 🙄

I told him to take advantage of the 14 day return policy and get a 64gb, He said that if he returned it they would charge him $250 because now its an open box. Is that so?

If they got it at Verizon they'll charge a 35.00 restocking fee, plus the difference of the cost between the 16 and 64.
