Playing devils advocate, an app should not have power to override the inherent restrictions built into the OS. If that is what is happening here then Apple isn't completely innocent either.

Like I mentioned a few post above yours I'm not entirely convinced about the problem due to how Facebook uses WebKit.

Well given that fact that people in this thread (including the OP who likes your posts) are complaining of usual high background usage despite countermeasures like turning off background app refresh it would seem something is indeed happening.
Sure. That in itself doesn't mean something related to spyware though unless there's actually something to point to that (which is essentially what I was asking about).
 
Under the definition of spyware on Wikipedia ( https://en.wikipedia.org/wiki/Spyware ) and other sources, it's a very loose and broad term. Many apps could possibly fall into the category even if they are relatively "benign". I don't know 100% what Facebook is are is not doing. But you know what they say about if it looks like a duck, swims like a duck, and quacks like a duck, then it probably is a duck.
I don't know about loose definitions but when the term spyware is used the "spy" aspect of it is certainly one of the main ones that gets associated with it in most people's minds. Not sure what sort of spying is really looking, waking, swimming, or quacking like given that there's nothing pointing to it.

I mean it can certainly be thrown out as one of the possibilities as far as simply brainstorming of what might be going on, but doesn't seem like much more beyond that without something in particular pointing to it.

Now, if we are simply using a generalized description of "software that is could be doing something unknown/unclear while it is running" it would cetrtainly fit in with what's going on with Facebook for some people, but I don't think that "spyware" would be an appropriate for just that (as it generally carries a more particular and somewhat different attribution for most people).
