Finder windows behind every other window on beta 4 - Fix?

Hi! I've been having an issue with the beta 3 and 4 where Finder windows, all of the sudden stay behind other application windows, even when I click the finder icon. I am not using Stage Manager, only on the iPad linked to my MBP using Universal Control.

Is there a way to fix this issue. It seems to happen randomly, but when it starts, I don't find the way to fix it until I restart.

the only thing I could think of doing, which is a pain in the butt, but I had to do it as well, is to format and re-install.
