iPod touch Fluctuating Ipod Touch?

Hi, When i use my 2 week old Ipod Touch 4g 32gig to play games and stuff i notice that the battery is fluctuating. Im using batterydoctor to watch and the battery indicator in the top right corner and they seem to for example when i play a game like Modern Combat 2 the battery is for example 60% and when i play it jumps down to 38% and then up to 59% is this NORMAL? should i replace it is this happening to you? And im running 4.3.3 by the way. not jailbroken.

Battery indicators from third party apps are very inaccurate.
Your battery is fine, the app just doesn't work properly (just like every other third party battery app).
