I have a 1st gen ipod touch. I have been having some problems out of the battery not holding a charge. Is there a way that I can get the people at the genius bar to give me a new model ipod touch? Yes the battery problems are real and been happening since june.

Yes, just take it in and explain the situation, that is what the 1-year warranty is for...

no, they will not give you a second gen, if you want one sell your 1st gen on ebay and use the money to buy a second gen

depending on your Apple store you may have a hard time seeing a genus. At my local Apple store the genus bar is turned into the "iPod store" I have to get both my MBP and my iPhone fix, but will have to wait until after the holidays. It would still be possible to get it fix, but it would take forever.

Make a Genius Bar appointment before you go. You can do this online by using this link.

It makes life a lot easier.

+1. My iPhone decided to stop working yesterday of all days, and I went to the store at around 6:30 and couldn't get an appointment until 8. Also, like others have been saying, they won't give you a new one, but you can always sell the old one once it's replaced.
