depends on where you are getting it from

Apple Store may have 4.3

a Radio Shack store better chance of not having 4.3

You could always just call the store and ask what firmware is pre-loaded on the device. They MAY know.

Also just a FYI there is a Ipod hack section in this forum. They might be more help. I wouldn't worry to much though. worst case you might have a tethered Jailbreak.

Most likelly you will get 4.2.1 but you never know.
