Because you are not an attorney and you don't understand the law so it's not surprising. I don't have time to be a law professor this evening so you will just have to wonder about it unless you want to take the time to research contract law.
This seems to be your go to response here. "I am very knowledgeable but I don't have time to say anything beyond you are wrong." Not the firs time I've seen this but it's definitely going to be my last (welcome to ignore). In short you're simply unhelpful. Period.

I can absolutely take being wrong but it's pointless to have s conversation with someone never willing to say why.

I am actually very helpful to many people here. I just don't want to spend a bunch of time explaining the contract issues here when OP has no damages anyhow since he/she is w/in the return period and can return. The only issue would be if they try to charge OP a restocking fee, which I suspect that they won't.

This has happened to a few people who bought "Verizon" iP7/7+ from BB and to test to see if they were unlocked activated them with TMobile SIMs and of course the devices locked to TMobile. And TMobile won't unlock unless the phones are active on TMobile for 40 days. These buyers were able to return for a refund to BB w/o a restocking fee. OP should be able to also. But OP probably won't need to b/c ATT will likely unlock it for him/her.
