THE website says though that if you bought it from an apple reseller and not an apple store the ourchase date may be off.

Hmmm...but that many months off? Anyway, I doubt the sales guy will even know about that qualification. If I say "The Apple site says it was registered months ago", hopefully he'll go with that.
 
I just bought a new 8GB Black iPod Nano two days ago at the Apple store on Michigan Avenue in Chicago. When I took it out of the case, it didn't have any plastic film over the scroll wheel or the screen. I'm guessing that this is just the standard packaging for the iPod Nano, and that yours was new as well. I can't vouch for the marks on the Nano, as mine didn't have anything on it when I took it out of the packaging, but I'd suspect that they got there from the factory.

Mine came with a plastic film over the screen. New 2nd Gen iPod nano. Green.

It's Micro Anvika... would you expect anything less?

And I doubt it was manufactured in October and didn't sell even since they were flying out of stores pre-Christmas.

An option if you have time (and patience) is to go into the Apple Store first (after making an online appointment for the iPod Genius) and ask them to check whether it's been registered to someone else or if it is an approximate date.
 
Well, they refused to give me a refund. Flat out refused. They would only give me a refund if I said I had an Apple case number, and as there was nothing technically wrong with the Nano, I couldn't get one. It was basically my word against theirs as to if it had already been opened. Not much I can do apart from take it to a consumer rights body - and even then it'd be my word against there's. :mad:

One lesson - only ever buy from an Apple Store. I only went to Micro Anvika because they gave me a 5% student discount.

This is a good idea. Get something in writing from Apple stating whether it's been previously owned, then go to the Consumer Rights people about it. It is illegal in the UK to pass off previously sold goods as new.
 
It's HIGHLY ILLEGAL for a store to sell 'used' goods as new, even if the box has been opened it's deemed as 'used' Dixons did this to me when i purchased a Compaq laptop many years ago, they took the power cord out, i demanded an exchange, when they wouldn't my friend threatened to report it to the police and pointed out that our Trading Standard laws classed them as selling used goods as new, they gave me an exchange, and a few blank disks and some other bits 'for my trouble'

Don't let them tell you your not entitled to a refund!! DEMAND a refund or threaten them with legal action!! THEY ARE BREAKING THE LAW!
 
I would phone Apple and get them to check out the serial number.

There are some contact numbers on this web site for you to try if Apple confirm it has been previously sold.

If your confident that it is used then go back there, calmly explain the situation, ask to speak to the manger, if that goes nowhere, demand to speak someone higher up, ie head office sort of thing, failing that then tell them you will be writing a letter of complaint regarding the store and service and get all the sales peeps names, write a letter which basically says its unacceptable, and one that outlines your situation, and that if you fail to receive a reply within a week/two you will be contacting trading standards regarding the matter as it quite blatantly a breach of contract. Hopefully by the point at which you've asked for their names for the letter they will be suitably nervous enough to give you a refund/exchange, also try to sound like you know a bit about law/this sort of thing, for example say something like "under the sales of good act (1979) I am fully entitled to, by law, a full refund if the goods were not as described/satisfactory, your refusing to give me a refund and are therefore breaking the law, the apple serial number check says its purchased in Oct, so your obligated, by law to refund me, and regardless it was not in a new condition when recieved" Hopefully if you sound like you know what your on about, they'll give in, did you pay with a credit card? If so, your more than likely protected through them, if so highlight to them that you will also have your credit company pursue the matter as well.

So how many people had stickers on their screens?

My 8GB didn't (from Currys) and my wife's pink 4GB (from Apple "premium reseller" in Chester) didn't either. Both had manual, headphones, etc. all wrapped up in small sleeves of plastic.

If nothing is wrong with it, whats the big deal really? Seems like a lot of effort to just get a refund. Legal action probably wouldn't even hold up since they discounted it for you, i.e. you didn't pay full retail price.

Yeah, I'd say that was pretty definitive. I'd return it also or at least demand a discount at refurb rates.

Doesn't matter what he paid, discounted or not. It's still illegal and would stand up in a British Court of law....

If your telling me in America shops can get around their legal obligation and hence legal action by discounting me for a product then thats absolutely crazy!
 
You're all too kind with your suggestions. I'll make an appointment with an iPod genius at the Regent St Apple Store and see if they can confirm my suspicions, and then go from there. :)
 
I don't know about your rules over there, but here in the states if you've paid on a credit card and you've gotten no relief from the store, now is the time to get the credit card company involved and tell them the situation.

I concur. I don't know what happened that some of you suddenly thought the Nano had plastic film over the screen/scroll wheel, but they don't. The one my fiance got for Christmas did not. The one I just bought last week did not. None of the 50 or so sitting in a case at my local Best Buy have plastic film over the display or click wheel.

Well it says that if you bought it from a 3rd party, the date may be a bit off. That the killer right there. Maybe that's the date Micro Anvika bought it from Apple. :eek: I don't know, but what it does mean is that they can say the date doesn't mean anything, or is not accurate in this case.

Not over the click wheel, but I thought my screen had one. Can't remember now, despite it being only 7 weeks old. The funny thing is that I opened the iPod case up and my friend is the one who took it out of the case, so I could ask him. :p
