iPod touch help me

hey ok i had my 1g ipod for over 3 years already and just yesterday my home button is messed up now (the button with the square in the middle) and when i click it it doesnt do anything and i was wonderring could apple have it replaced or fixed without a charge i bought it at best buy for 300 dollars and the 2gs now are only 230 is there a chance that they could replace it with a 2g

It's out of warranty. No chance Apple will fix it for free or replace it. Are you sure it's just not in software? Try doing a full restore.
