That sounds like a great way to acquaint him with the constabulary... particularly if said phone happens to have come off a certain UPS truck in SF.

I am assuming that the phone was merely not fully paid off (debt default/civil issue) and not stolen(crime)

Why assume that? Stolen phones are blacklisted and there’s nothing in the discussion pointing to one or the other situation.
 
Showing my ignorance here, so long as the seller is completely upfront about the situation, would it be possible to sell the phone without any trouble (like advertising that you're selling stolen property?) For instance, would the following listing be OK? "We got duped into buying a blacklisted phone, can't use it in my country, anyone interested this blacklisted phone so that I can recoup at least some of our money? Anyone interested in a working phone for parts?"
True, that would be the ethical way to do it.

Moot point, additional comments from the OP make it sound like it's actually just carrier locked to T-Mobile, not actually blacklisted.

They should just contact T-Mobile to get things cleared up.
