Hinge broken cover design flaw

My MBA Rev A has blown its hinge cover, as this was a design flaw my research shows that Apple were doing a free fix. As this was back in 2008-2009 are Apple still fixing this issue for free if the issue has only just happened ???

As long as the defect meets the criteria listed in the support article, you should be eligible for non-warranty repair.
