technically I'm not committing fraud, I'm taking the phone back for a design flaw but Apple doesn't want to own up to it so I'm just saying that it has another issue which I only encountered twice. They really should have known that the stuff would have dented and bent with use.

hmmmm, Over 5 million sold and only a hand full of bend complaints......I'm thinking it's more of a user flaw. But whatever makes you feel better about committing fraud.

well my 4 and 3g didn't bend and I used them more ruggedly than the 5. I've never even dropped this phone and dust is already getting in. I must have gotten a defective design.

I guess Apple will get the final word. Please let us know if you got a free phone or if they make you pay the $50 like you should.
 
You don't need to lie. Your phone is obviously bent. A phone should not bend with normal use. Apple should replace it.
 
To be honest, if you do get it replaced you will probably get a unreliable iPhone... that will need replacing ever 2 weeks.

I swear the phone is bent I asked multiple people and they saw it too it's just really hard to capture in picture form with a webcam you really need to be there in person to see it. If you lay your iphone 5 on a flat surface and press down on the bottom does it raise? Mine does which means it is

It will be fine. People on the forums tend to overreact to everything. Just go in. You paid for a PERFECT phone, and you should get one.

So you are saying this from your use? This is why you have Apple Care+ and are PROTECTED against this type of issue. If it is past the 30 day WARRANTY (note the difference: Protection is preventative and purchased, Warranty is manufacture, just like a car), then Apple has no choice but to be fair and charge you the $49 for the replacement. Plain and simple.

If you had a car with the manufacture warranty that expires after 100,000 mi/10 years (i.e. Apple's 30 day warranty), and full insurance coverage (i.e. Apple Care+)... you wouldn't go to the dealer to fix hail damage (especially if that manufacture warranty had expired). You would allow the insurance company to do it's thing, and get your car fixed. :)

LOL, burn. Side note, the only thing that really matters in this case is how long ago you bought your phone. If you bought it yesterday and it is bent you might get a genius to just give you a new phone. But if you have had the phone for a week obviously you are the cause of the bend. You may not remember causing it but stuff like that doesn't just happen.
 
I'll be a little dishonest (ok, a lot dishonest) but... Every single time that I need to replace an iPhone for something little I do this... I tell the genius that from time to time my iPhone says, no SIM card inserted, don't mention any other defect or any other concerns... They always ask if you have gotten another SIM card and I always say, yes, from an AT&T store, that was the first thing that I did. I also add that I already tried to adjust the SIM card as much as I could...
The genius won't put your iPhone on a table to see if it's a little bent or not...
Or concentrate on any other thing than on what you are telling...
Again... I do this because I'm dishonest and because it let's me get in and out quick without having to explain this or that...

I guess so, a scratch is nothing compared to a BEND. Which is obviously resulting from a defective design if I can strain my 4 even harder without bneding, the only thing my 5 has been doing is sitting in my front pocket of loose fitting pants, and that shouldn't cause it to bend.
 
I have Verizon, and I just called them about the issue and they said that it is now user damage, wow congratulations Apple you just went from one of my favorite companies to one of the worst. Occasional bursts of kindness to cover up them knocking most devices out of warranty as soon as it's dropped. My phone literally did this overnight, I didn't notice until maybe 11am today that dirt was accumulating. It wasn't like that last night

Then just use the SIM Card excuse with Verizon iPhones too.. Its an iPhone 5, all of them have SIM cards now regardless of network technology, and all of them will refuse to work without a SIM card inserted. (C-SIM on CDMA, U-SIM for GSM...otherwise known as a regular SIM Card)

Dude seriously you need to **** about it being a defective design. They sold over 5 million phones and there is only a handful of people complaining about a bend that probably resulted from their own stupidity anyway.
