It's possible, but there's no good way to know for sure if it's really brand new and still packaged. Now, if someone opened it and hasn't used it beyond seeing that it still has iOS 6, that's a bit different.

I just bought an unopened iPhone 5 today and it was still running iOS 6.0.1. I updated to iOS 7.1 immediately.

You just have to look and you'll find one. I didn't even do it intentionally.
