I Googled it and found that they're making a second album... I don't know if you're involved in that or not

Excuse me?

Get a lawyer if you really mean it.
Sell a few hundred copies for any amount of money you can get. Extrapolate that out to the number of (unauthorized) downloads (put up by your friends) and sue them for loss of income.

Lawyers, FBI, cops and judges… not fun. Let them know that they might beat the wrap, but they won't beat the ride.

Harassment, a restraining order or a lawsuit to go after him legally ... your choice.

At this point, it'll probably just end up being a harassment/trespassing/malicious destruction of property/thievery charge, and not the copyright claim. Not that I wouldn't like to go after him for it, as that's what this is about, but I'm not going to sell .mp3s of a middle schooler being a ******* with a microphone. It's possible still, though. I don't want money, that's the thing: I just want justice, in particular for this copyright issue, and the fact that he put my full name and hometown on the torrents along with them.

Although...If I sold one copy to someone for $2, I'd get over $40,000 if I sued them and won :p

I'm not doing that, though.

On youtube there is a self done interview of someone talking about how he is going to make a second platypus album...

P.S... Nvm i feel like an idiot, you're dustin!

Haha! :D It's quite all right.

Yes, Industrial Platypus is my legitimate project, unlike this. I will be registering the copyright on that for sure as soon as it's done...It's cool that people are actually finding and viewing that video, though. SMC is in progress right now.

And yep, that's me. :p

By the way: In case you couldn't tell, I'm not really British! :p

I fail to see how this is about copyright anymore...it seems you are looking for a legal avenue for a personal problem.

Your issue is with these people, not with the people you dont know who are downloading and listening to this.

Obviously these people who have done this to you have a problem with you, personally. Thats something you need to deal with, and I dont think copyright infringement is going to get you anywhere with folks who obviously have crap for brains and coal for a heart. Schoolyard justice? Only in the movies.

Its like saying "Cmon guys, stop it! Stop it or Ill tell!" and them simply doing what degenerates do, make it worse. :(

Upon further thought, Just keep targetting the torrent sites. Let them know (politely) that you are the artist and the person posting the torrent did so without your knowledge or permission and you request that it be removed. Do this on each torrent site. Eventually it will be gone, and possibly the user's IP banned. I would vaguely hint at further action, but nothing specific. These hosts dont want issues.

This is my main problem. As I said, I do have the problem with the copyrights and such, but if my full name, hometown and phone number were not attached, I'd probably just be pissed (like I was until I found out about the info and the continuing..), and not be wanting to take further action. At this point, it's very frustrating realising there's basically nothing I can do.

Edit: By the way, it's still a copyright issue, even if it's not targeting the people who downloaded it.

From the US Copyright law:

§ 106. Exclusive rights in copyrighted works

Subject to sections 107 through 122, the owner of copyright under this title has the exclusive rights to do and to authorize any of the following:

(1) to reproduce the copyrighted work in copies or phonorecords;

(2) to prepare derivative works based upon the copyrighted work;

(3) to distribute copies or phonorecords of the copyrighted work to the public by sale or other transfer of ownership, or by rental, lease, or lending;

(4) in the case of literary, musical, dramatic, and choreographic works, pantomimes, and motion pictures and other audiovisual works, to perform the copyrighted work publicly;

(5) in the case of literary, musical, dramatic, and choreographic works, pantomimes, and pictorial, graphic, or sculptural works, including the individual images of a motion picture or other audiovisual work, to display the copyrighted work publicly; and

(6) in the case of sound recordings, to perform the copyrighted work publicly by means of a digital audio transmission.

§ 501. Infringement of copyright2

(a) Anyone who violates any of the exclusive rights of the copyright owner as provided by sections 106 through 122 or of the author as provided in section 106A(a)

This is my current plan :) I haven't seen any results yet, but I've gotten a few responses. I basically tell them that there are people in my hometown spreading these files across the internet, and that they belong to me and I wish to have them removed. I also tell them that their sites will not be the target of anything legal, I just wish them to be removed ASAP...that sort of thing.

I would go with not a part of anything legal as long as the files are permanantly removed.

It's very unlikely, but yes. It's still frustrating that he has a track record of being able to do anything he wants without punishment. :( At this point, though, I don't know. If some big update comes in, or if someone says something, I'll respond, but the thread is pretty much useless until something else happens. Thanks for the discussion and thoughts, guys.
