I can get a 3GS 32B for $170 but can I activate it like this?

Right now i Have a normal phone on AT&T without any data plan. My contract ends in December. I want to know if I can activate the iPhone without signing a new contract and then I can cancel it in December? I plan on putting a 200mB plan..

If you're buying the phone through an individual, then the price is not subsidized through AT&T and doesn't require signing a new contract.
