My old iphone 5c died today. It had ios8. I got a used iphone 5c that came with ios7 pre-installed. I want to restore the new phone using icloud so i can get my contacts, photos etc. Icloud says I can't because the ios on the new phone is old. I updated the phone to ios8. But when I erase all content and settings to it goes back to ios 7. Is there another way to get my icloud data onto my phone? This makes no sense. What am I missing? Please help me! I have spent hours trying to figure this out and feel like I'm going crazy.

Update your phone to iOS 8.3 via the settings menu, then install your iCloud backup.
OR use iTunes which will load the update for you, then backup from iCloud.
