I have been working on research for the past three days and during the imac once but the slight humming/rattling is still present in all its fury, and if anything has gotten louder.

I pulled my imac out a little bit and let my ear run around the body for a little while and traced it to the circular fan opening in the rear of the imac.

The problem has gotten so bad as to me being unable to sit at the computer for more than five minutes at a time, and i can hardly read articles without loosing my train of thought to this annoying hum.

So, is this a problem apple will gladly replace my imac for? or am i just going to have to live with it? *note imac given to me as a christmas present so it is still under warranty and should be new enough to give the 'i made the switch but am quickly dissapointed with your product' speech*

And if i can get the imac replaced, is it possible to upgrade to a 24" during the replacement?

    all help is appreciated

Apple has a 90 day return policy. Beyond that, they'll fix it for free until your automatic one-year warranty runs out. After THAT, you have to subscribe to the Apple Care program to have repairs (or subsequent replacement) be an option. Therefore, call Apple TODAY (1-800-APL-CARE) and tell them the problem. Act angry on the phone if necessary to get a certified Apple technician to come to your home and fix your Mac in your house. You do NOT have to take the Mac anywhere to have it fixed. They come to you. If you wait too long, they'll be much more hesitant to replace it, so seriously call now.

By return policy, you mean return for money back or replace?
