My 13rMBP has just begun showing signs of bad image retention, even without the image retention test. (only have to switch to dashboard or even green backgrounds for my eyes to want to fall out of their sockets.)

the bad news, is if the warranty only lasts one year, will they even consider looking at it if the warranty ended on Jan 4?

All I can offer is for you to try. There is no official policy stating they'll deal with this issue after the warranty expires.

I would advise getting it to them ASAP, as its only been a Month since the warranty expired. In the past I've had good will from them when my iPad was 6 weeks out of warranty as I stated I use it for work and didn't have time to send it in and be without it for a while.
