iPhone 3GS problems: software or hardware related?

I'm beginning to think I have a bad battery because my battery performance is not as good as my 1st Gen iPhone. Sure, on the first day I was all excited about the phone and used all the features and such, but it quickly became just my phone. I'm totally back to using my phone like I've always used it and I am constantly finding my battery at below 50% after a daytime of little use. It's not so bad that it's causing me to be without a phone, but it's definitely not lasting as long as my 1st Gen.

Same with me. I have 3G on, fetch data 15 min, push notifications on, wifi on, and 40% screen brightness. This is only my 2nd day of owning the 3GS and right now I have about 9 hours stand by, 4 hours of usage (usage was one 30 min vid, listening to music for 30min, and light browsing/checking email. Now I have 23% battery remaining. I hope this poor battery performance gets fixed though in an update. Even with 3.0 installed, my first gen iPhone lasted MUCH longer.
 
I believe it has to be Software. The 3GS battery capacity is 1219 mAh while the 3G and original iPhone had a battery capacity of 1150 mAh.

Battery life on my 3G was pretty bad until the first update came, so I'm very optimistic.

Come on 3.1!
 
Hoping it's software. Have a look at this. 17% battery life. Couple phone calls (no more than 10 min. total), couple texts and listening to some music and podcasts. Maybe about another 10 minutes of internet browsing -- no games or apps. 17%.

I'm at the Apple Store getting my MBP fixed, and I complained to the Genius. He's been giving me the runaround. To be honest I'd like to keep my current phone, I just want to stop all this battery fluctuation. Yesterday it went from 22% to 80% and then died at 77%. I restored my phone and still same issue.

That exact same thing happened when i got the 3Gs. I worked fine the first 3 days then after that the battery would die after about an hour or 2 of little use (mostly text messages or phone calls). When i took it back to apple they said that it was a software issue and wiped the phone clean. not even an hour later it was doing the same thing. So the next day, luckly, when i was waiting for my appointment it started to do the percent jumping around and i made one of them look at it just as it went from 47 - 88 - to 50% and then just shutdown.
they gave me an new phone and i took it home and transferred all files and apps and my new phone is working fine now...not a single issue. Battery life great!

But i would like to know from others that had this issue: My first iPhone (one that got returned) was a 32G White one. when i returned it i got the 32G black one -- so was just wondering if it might have been just the white ones????
