iPhone 3gs with 3.1.3 firmware jailbreak question

I bought a refurbished 3gs recently, (it has not come in yet)

if the firmware I get is 3.1.3, can i jailbreak and unlock it for 3.1.3?

Can I upgrade to 4.0.1 and then jailbreak/unlock it or do i need the shsh hashes?

jailbreakme.com works up to 4.0.1.
Apple is no longer signing the SHSHs for 4.0.1, so you're going to have to be especially careful.

BTW, do not upgrade to 4.0.2. You will not be able to jailbreak. The dev team is not releasing any jailbreak until 4.1, minimum.

When you get the phone, use TinyUmbrella to see if perhaps the previous owner saved any hashes.
