Iphone Headphones broke before use

Tried using my apple iphone headphones the one with the mic today but only the left earpiece and the pause/answer button works the right earpiece doesnt work, who should i contact for a replacement as they was brand new out of the box today? any ideas ?

definitely contact apple, those headphones are worth a lot of money and they should be working, Im sure apple will find a way to replace or exchange the defective headphones.

Those headphones are covered for a year like the phone. Anything that came with the phone is.
