iPhone loses place paused (iPod)

This is driving me nuts. I hoping I'm just missing something.

When I listen to mp3 audiobooks on my iPhone and pause it for various reasons, like getting to school, after awhile it reverts back to the music list and loses my place that I paused at. The ipod I have doesn't do this. It stays paused at the same spot indefinitely. Help?

in iTunes, get info, remember to check "remember playback position". that way if you leave the chapter (your choice or its), when you come back it will start at the right place.

Actually the iPhone does "forget" sometimes (after using certain apps (maybe YouTube but need to check))and it also bothers me. Hope this will be corrected on the first update.
