Iphone5 Restrictions Passcode

Hello. I am trying to take the restrictions passcode off of my daughters iPhone5. My husband (her stepfather) put it on her phone and we are going through a divorce and he will not give me the passcode. I tried to back up her phone on the computer and reset it but it is still asking for the passcode in order to reset it. Please help. Thank you.

Just restore it with itunes and setup as new.
