Nope - I actually applied for the $25 cash option (which would just about cover the DIY cost of replacing the battery in my 2G that I shelled out earlier this year).

IIRC, Apple had to finalize the settlement, agree to the rebates, and then they would take a few weeks to process. I'm not sure where any of these things are at, so I'm just assuming at some random day in the (possibly distant) future I'll get the check in the mail.

If you take part in a lawsuit against Apple, you should sell all your Apple stuff. (and if you make a claim in a class action, you are participating in a lawsuit).

We all have to pay for this crap through higher prices.

What are you talking about? Maybe Appel should have included a better battery. I know some worked fine but some died very quickly. I don't own an iPod but my sister has a Gen1 and she just bought a new powerbook, airport express, iPod mini, Creature speakers, keyboard and mouse all through the online Apple store. I doubt that Apple would agree that she NOT buy their products just becuase she gets a 50 rebate coupon.

Yeah, because you know Apple is getting real screwed by paying up to 1.3 million iPod customers $25 or forcing customers to come back with a $50 coupon on their next Apple purchase (I myself am getting a Mac Mini once that settlement arrives)... Apple is getting a slap on the wrist if any punishment at all. After lawyer fees and the whole case is settled, Apple is only paying up to $15 million according to Apple Insider's report. Not exactly reason to raise prices when Apple's profits easily trounce those costs.

And you shouldn't be expecting your money yet. Some people still need to send their forms in by September 30th (points to self!).

 This is the kind of rabid-fanboyism that gives Apple users a bad name. You should sell all your Apple products and never post about them on the internet or talk to anyone about them again. They released a product that had 1) occasionally a faulty battery, 2) a battery that had a lifetime significantly less than the rest of the product but failed to offer anyway to replace or exchange the battery, wether covered under warranty or for a charge, and 3) failed to notify consumers that the lifespan of their (up to) $500 piece of electronics was linked directly to the life of the $20 battery.

Yes, they offer a repair service now, but that is a fairly recent development. Plus, there were several models of the iPod that made it INTENTIONALLY difficult to replace the battery yourself (specifically they covered everything in an adhesive glue so you couldn't pull the battery out).

Thought the deadline was August 30th or within the warranty of your iPod, whichever was later? I can't remember what the site was for claims so I can't check on it myself.

For 3rd gen iPods it's two years after original purchase or Sept. 30th, 2005 - whiever is later

For all other claims the deadline for submitting a claim is Sept. 30th, 2005.

If you want the forms do a Google search.

No check yet

I mailed in my claim on June 7th and haven't seen my settlement check yet.

I think this is from the lawyers who are the lead counsel on the case, Girard Gibbs? Anyways,

14. When Will I Receive My Benefits Under The Settlement?

Under the terms of the Superior Court’s order granting final approval of settlement, Apple is not legally required to begin the process of fulfilling Class members’ claims until the judgment and order in the case is final, which occurs only after the time for appeal expires and no appeal is filed or, if an appeal is filed, after that appeal is resolved by the California Court of Appeal. On October 24, 2005, just prior to the time for appeal was to expire, two individuals filed an appeal from the Superior Court’s order approving the settlement. As Class Counsel, we are in the process of responding to that appeal, which we believe to be without merit. However, until that appeal is withdrawn, dismissed, or resolved by the Court of Appeal, Apple cannot be legally required to begin the process of fulfilling claims, or pay Class Counsel’s attorneys’ fees and expenses. We are working as diligently as possible to have this appeal dismissed and/or resolved by the California Court of Appeal. We will update this site with further information as it becomes available.

It's posted at http://girardgibbs.com/ipodsettlementfaqs.asp ... I wonder who the appeal was from and what it claims? Sucks that this is being drawn out so long. I was hoping to get the check before the end of the year for a little holiday gift to myself, but I guess I will have to make it a birthday present (February, for me)!

BTW, is anyone out there interested in selling their credits for cash? Say 75% of face value ($37.50)?
