Does it only work when the Head phones are out? and can it be turned off from the menu?

yes, only when headphones are unplugged. i haven't found a menu item for it. but there are separate volume levels - one for headphones, one for speaker. so you can turn the speaker all the way down and effectively have it off and keep normal volume levels when plugging in headphones.
