Even with a reboot and nothing open and sitting there cold, I check the load average and it's 1.80 1.81 and 1.70. How can it possibly be using one core and 70% of the second core when it is not even doing anything?

software not yet properly optimised ? would also explain the battery life issues...

may get better with IOS9.

Clearly software is failing/failed. Try a restore, hardware is probably fine.
 
OK just updated to ios 9, my ipod touch 6g has all apps closed, wifi and bluetooth off, it's been sitting on the desk doing nothing for 20 minutes, I open up an analyser app that shows the average loads as 2.80 2.80 2.50 WTF.

A cpu that's 83% idle doesn't seem very heavily loaded.
Those 2.74 processes are probably waiting for something other than cpu.
