Agreed. As long as your information is "in the cloud" it is always accessible by someone.

Apple retains a "master key" to decrypt your info upon request (like a government search)
 
Somewhere in apple documentation, it says your iCloud data is encrypted. However this article:

I think the bolded part from the article says it all.

Apple — which declined to comment — and Microsoft, along with Verizon Online, state in their user agreements that they reserve the right to actively search stored files.
