If you do a restore on it before you take it in, the warranty is fine. As long as they don't find out/can tell basically. 🙂
 
K. Do you know any way i can get the usb to recognize my ipod so i can get it working in itunes to do a restore?

Make sure iTunes is updated to 8.1.1 do not update to 8.2, it disables restoring in DFU, and then you can try a different usb port.
 
I'm pretty sure i have the 8.1.1 now but how do i double-check? Just want to make sure since my ipod isn't recognized
