If they signed a contract with apple pay then yes if they didnt they can reverse there lawsuit for damages.
 
Now, how long until there's a class action lawsuit against Apple for refusing any other subscription/payment in their App, but through their App store (with the 30% fee) ?
 
Not quite sure how I feel about this. Americans sure do seem to love a court case though.

How is it any different from not accepting certain credit/debit/charge cards though?

Don't know if this is good or bad. It could force these companies to re-enable NFC, however it could encourage some other companies to never even install NFC terminals so they cannot be targeted by such legal action.

They have to, by law, by October 2015(All the new terminals for chip cards have NFC built in). If they don't upgrade they will be directly liable for credit card fraud.
 
I really don't see this lawsuit going anywhere if it is filed. The market will take care of MCX long before a class action lawsuit is resolved.
 
As much as I dislike what they did, I can't imagine what the grounds for a suit would be. If anyone would have grounds to sue, I would think it would be the card companies if turning off NFC violated the merchants' agreements with them.

As I consumer, I prefer to punish them by taking my business elsewhere rather than suing them.
 
Yes I suffered deep trauma. I walked into a convenience store to purchase my lunch without any money on my person, and when I went to pay for my three two liter bottles of soda and giant bag of candy bars they told me I couldn't pay by waving my telephone at them.

I have never been so outraged. My pain and suffering inflicted by this flagrant human rights violation are as real and I am seeking 2.8 billion dollars to cover damages to my sanity.

I demand satisfaction.

Damn, you should definitely receive thousands in compensation for this. I can't even imagine what you went through.
 
didn't take long for the blood sucking lawyers to get onto it ....

(but in this instance it might be a good thing ... not to defend Apple or Google, but to ensure that customers have all the choice)

this seems true. looks like merchants are gonna be forced to accept NFC whether they like it or not b/c of credit issuers and bank pressure.

I don't think EMV POS terminals require NFC contactless capabilities.

but I'm not certain....

You have to look at this case objectively. These companies already accept credit cards, and they already have the point of sale terminals that accept NFC payments. They ACTIVELY disabled a form of payment that has 0 effect on their already existing payment methods and fees just so that they can push for their own solution.

Trust me, if MCX gets away with this nonsense, it will just be a matter of time before they have to deploy CurrentC via a web browser. If they want to demand their freedom to reject Apple Pay and Google Wallet, they can only expect the tech giants to practice their own version of freedom to reject their app submissions with a simple update to their Terms of Service declarations.
 
Credit card companies have to strike back and they will do so with a lawsuit. I would not be surprised if coming soon the agreement companies have to sign to use visa or amex or master card required NFC to be turned back on. These agreements are long but come up for renewal and i suspect having CurrentC going was a means to have a more level playing field a field they lost day one.

It's not a law. It's just the banks and credit card companies are passing liability to the merchants effective that date if they don't decide to go that route. In fact, banks can choose to issue cards that require a PIN number instead of a signature, but the switch to PINs will not be required in October 2015.

Although I see your point - and I agree with it. I believe you're misconstruing what Apple Pay really is & what it isn't. Apple Pay is NOT a new form payment that places additional burden to accept.

All it is - is credit/debit card payment - placed/payed using a phone. That's all.

If POS terminal has NFC - then Apple Pay is accepted using credit card networks that merchant has an agreement with (MasterCard, Visa, America Express).

The issue is, is consortium legally allowed to use its market power to force the disablement of any competing forms or methods of payment. Thereby constraining trade? Again, they already accept MasterCard/visa/AmEx and already have NFC (NFC is default with recent POS terminals).

Secondly. Their competitor is not yet released. However, the consortium is using their market power (lawfully or unlawfully) to prevent customer adoption before their product/competitor is released.

This seems like The US DOJ or FTC should have been investigating long before.
