"even customers fulfilling their two-year contracts with AT&T for the iPhone are unable to switch carriers and continue using their handsets"

Switch to what carrier? T-Mobile?

unlocked phones are easier to sell, we do not need to switch to T-Mobile but it is an option.

And when can I order a Big Mac at Burger King?!!?

Bad analogy. This is not about forcing non-exclusivity for new phones, this is about unlocking the phone after the contract is over.

I don't see tho, why Apple is involved in this lawsuit. It's AT&T's obligation to unlock the phones, not Apple's, no matter what deals they struck with Apple.

My wife is using a 3G with no data plan. It is not jailbroken. It doesn't get any Maps or apps that require data access unless she is on WiFi.

I think that it's pretty disgusting that Apple/AT&T won't unlock your iPhone after you've fulfilled the terms of the contract. You shouldn't have to jailbreak your phone in order to do something that AT&T willingly does for every other device on their network.

I believe that AT&T has stated that it's Apple that must unlock the iPhone. Apparently, AT&T doesn't even have the unlock codes.

Oh this is interesting.

The plaintiffs have argued that even customers fulfilling their two-year contracts with AT&T for the iPhone are unable to switch carriers and continue using their handsets, effectively locking them in to AT&T for longer than their signed contract unless they are willing to switch phones.

That's a big reason why I don't like the iPhone. Basically turns it into an iPod when your contract is up. :) And besides, AT&T's new data plans are terrible so I bet a lot of people are going to sign up for his lawsuit.... and hope they can jump ship to Verizon.

Of course, when the class action wins al of the iphones out there will suddenly work on Verizon.

Why not T-Mobile? It's the largest carrier with the best coverage in the entire country. They cover about 99% of the area and basically the entire population. My experiences where pretty good with them, high speed, no dropped calls.

that how it is everywhere, even some communist country (eg singapore, hong kong, ..._ are better than USA! :p

Isn't the whole of Europe communist, too? At least that's what I hear here very often. I haven't found any traces here yet, will keep looking. :D

Yes, for instance. Or selling it to someone who takes it abroad or whatever.

I think they said in the beginning, that they would unlock your iPhone after your contract was over. I never knew if that came to be true. If so, there would be no argument.
Does anyone know about this?

No Sir, I've been aan iPhone user since 2007 and a cingular/AT&T customer even longer....no where in my contract does AT&T say they will unlock my iPhone after 2 years...this lawsuit will be dismissed with prejudice

This is asinine. The phone can't even WORK on other carriers because they all use different technologies and frequencies. What, are you gonna take your GSM iPhone to Verizon's CDMA network and expect it to work? Neither ATT or Apple promised you your iPhone would work on another network after two years. If you don't like it, buy a phone on someone elses network.

As for the continued monopoly claims regarding Apps, again if you don't like Apple's system, which they have been upfront about since the day it was announced, go with someone else. Nintendo, Microsoft, Sony, etc. all control what software is and isn't officially available for their devices. Should we start suing them too?

Funny, European telcos do have the unlock codes. Seems like AT&T should maybe ask nicely.

whiners

No iPhone on Verizon or TMobile? Boo effin hoo!

I can't believe there is even a lawsuit!!! One would think that a bunch of 3rd graders are behind this crock of a lawsuit. "He has and I want, make him give me!!!"

I was not pleased with the exclusivity agreements and did not want to switch carriers, so guess what? I went out and bought two Droids for the price of one yesterday, and I love it already. I am even canceling my mobileme membership because I am getting a little sick of apples "ecosystem" garbage. I am going full on google due to Apple's ridiculousness as of late.

Vote with your wallet, not with your whiny lawsuits.

If you don't like it, don't use it and Apple will painfully get the picture. DO NOT whine about it, it does not help, and only serves to make one look boobish.

There's a great big world outside of the United States.

Even if AT&T (not Apple) unlocked the phone after your contract ended, you could only use it on T-Mobile (which is not the largest network in the U.S.), and your data would only be at Edge (not 3G) speeds, since T-Mobile's 3G network and AT&T's are on different frequencies.

I agree that mobile phone service providers (like AT&T and Verizon) should have to unlock phones after the contract is up, but it would be ridiculous to require phone manufacturers to make phones that will work on any network you choose. Apple was well within their rights to design a phone that would work best with AT&T's network, and to agree to work exclusively with AT&T in selling and providing service to new phones.

I hate these stupid Class-Action lawsuits, and really hate that the only people who 'win' from this are the primary lawyers leading the process. Every time another of these pointless suits is filed, it simply raises the overheads for the companies impacted and requires future rates for products and services to increase to cover associated costs.

If I lived anywhere else in the world but the US, I'd be able to switch to any other GSM vendor once my contractual obligation is up, but here is the US we are slightly hampered by the fact that we remain unable to follow the same standards as the rest of the world and pushed out CDMA and TDMA based solutions. The fact that I can't take my GSM phone from AT&T to Sprint or Verizon after my contract with AT&T is up does not mean the device is "effectively locked" to AT&T, just that we are paying the price for implementing multiple, incompatible but competing technologies over the years. Oh, and that Sprint and Verizon are really unhappy at having chosen technologies that are in general decline.....

This is a stupid lawsuit and reflects badly on the main participants. They should feel ashamed for starting this process.

did you just post your opinion as fact....TMobile is not the Largest US carrier in fact they are the FOURTH largest US carrier behind Sprint...and Tmobile's coverage does not cover the entire population...Leave the drugs alone...I didn't know you liked to get wet

iPhone 3G/3GS with t-mobile no contract $50 unlimited talk time plan is tempting (with out the data plan if the older iPhones are unlocked)
