Hey guys so we have a bit of an odd situation here and I would like some advice, so here it goes.

Almost 2 months ago now my son purchased a mac mini online through my work discount website. It came directly from Apple with all the bells and whistles he added. I work from home and he works nights so it was my responsibility to sign for it as he's asleep all day. So 2 days before his expected delivery date once he wakes up in the evening he asks me for his package, I say what package. UPS tracking says his mac mini was delivered today and signed for at 11:17 am but not by me, I was on a Teams work meeting at that time. He calls Apple, they open an investigation, 2 days later they said it was delivered to the wrong address they will send him a replacement and refund him his money back. I move my work desk to face the front window and look out for UPS trucks and run outside everytime I see one. Finally it comes in but even then the UPS driver never has me sign for it. It's been 3 weeks now since he got his replacement but still no Refund back to his account.

Now here's the kicker, we just had an atmospheric river with extremely high winds come through northern California which caused a mess. Yesterday as I was clearing the gutters, downed branches and debris around the house and guess what I find in the backyard. The first mac mini in its original package unopened however the shipping box had been clearly opened. We think whomever received it may have thought oh it's an Apple product it can be tracked, maybe UPS went looking for it back and they panicked or who knows what they thought to decide to open the shipping box but not the mac mini box and then toss it in our backyard. We don't really use our backyard as it's really small and narrow and basically just runs down the side of our garage.

I gave it to my son last night before he took off to work, told him where I found it and he tells me. I already got mine, I know you wanted one, it's your birthday in a few days, if it still works you can have it since I still have not gotten my refund from them. So I said thanks son, this sure beats a funny birthday card that they don't write anything inside of anyways.

Now here's my question, if it did make it trough the storm and powers on can I even still really use it? Will it be operable? Will I be able to sign in to iTunes on it? Will all the software bells and whistles he purchased for it work for me? Or can Apple have made it into a brick and reported it stolen so it's not operable at all like they do to stolen devices?
 
I’m confused as to why you would get a refund. The original went missing and Apple sent out a replacement. Why would they issue a refund?

The right thing to do would be to call Apple and ship it back, If you reported it missing they likely blacklisted the serial number.

Why would he get a replacement and a refund? This makes no sense.

This is quite a shaggy dog story that seems to boil down to: you ordered a Mac Mini, didn't receive it, Apple sent you a replacement and now the "lost" Mini has mysteriously re-appeared in your own backyard and you want to use it. Sorry, but this all sounds a bit dodgy!

I'm guessing that they charged him when the second one went out, and were supposed to refund the first one (which seemingly never happened). I don't think you'll have a problem using the mac, but you might have a problem when it comes to warranty or trade-in. Apple will have flagged that serial number as stolen and will probably not support it at all.

If you decide to keep it, I would have your son call apple and tell them he found it and wants to keep it. This should lift any warranty problems off of it. I would also make sure that call is "recorded" in some official manner (case # etc)
 
I was just as surprised to hear from the Apple representative that they would send him a replacement and issue him a refund too. However I also heard it loud and clear as the call was on speaker phone when he initially called to report it never arrived.

I would imagine too that Apple would have blacklisted the serial number so I'll have him call them later this evening and see how Apple would like to handle this.

Sorry, but I don't think I'd be keeping the "found" MacMini. Seems a bit dodgy to me. I'm thinking "Finders Keepers Losers Weepers" is not applicable here ?

edit: That said if Apple said keep it, we don’t want it. Then more power to you. Though I’d ask about warranty.

I didn't think so either but thought I would ask.

Update: I called Apple today and after explaining everything they said it would not have to be returned. It was basically written off as lost and damaged by Apple and we would be able to keep it. However since the conditions I found it in were very soggy n wet, it would not be covered by any warranty or Apple care if it did power on and work.

should've recorded the call, time and date as I'm sure Apple recorded it. call them up speak to someone senior have them make good on their word, don't take excuses. Apple rep may get the brunt of it or hopefully better training along with other reps so such a promise/mistake is never made again.

Then I would check for water damage before turning it on. Or rather, I would open the package and put the mini with like 10 kg of rice for a week.
