Regarding auto sleep/wake, my case does indeed function properly.

With the latch, I've found that applying a little bit of light pressure ~1-1.5 inches from the latch when opening/closing helps to kind of cup/ease the latch on over the side of the iPad without that scratching kind of feeling it has if you just try to press it shut. Not a great workaround, but for me seems to work fine.

it seems the latch is not causing any damage / scratching. i've been watching this case in use since the day it was released pretty much and that area is still pristine.

Macally customer support is HORRIBLE.

I'm almost questioning if I should even have it replaced by them or just return and move onto a different case.

I just get this feeling if I try to get a replacement something will go awry.

Avoid this case. magnetic strip does NOT work.

too bad to hear about the CS, the macally cases look great. I wish the blue slim folio were actually dark blue instead of gray, though.

I got the case in black and have been using it for about 2 weeks. I personally love this case and have gotten several compliments for it. It has a very slick look to it, easy to take in and out, had no problem with the magnet or the latches, and overall its very durable.
