I do feel better venting.
However I paid about 3 grand for this and the battery has now doubled in size and I started out friendly because I thought apple was famous for customer support. They clearly are trying to hide/ignore the issue even though it clearly exists. I can understand AppleCare for user errors and mistakes but I don't need that. I have been working on computers and building them since 1994 and I have never had a battery issue like this.
They should gave said "sorry, we will send out a replacement and a return shipping package for the bad battery. If it's not really expanded we may have to charge you but from the found of it, it sounds like it should be free. "
not " we can't help you since you font have AppleCare"
I will know more today but believe me this will not only be tweeter and blogged if I don't get a replacement not to mention a complaint with the bbb and the ny state attorney generals office.
This really is ridiculous and I will now hesitate to recommend apple laptops.
To make matters worse the house across the street burned down 2 weeks ago from a fire in their computer room. Not good.

If that happened to me, I'd choose a genius bar appointment at the busiest day at the apple store, on a weekend. I'd slowly walk though the middle of the store holding the battery outstretched on my oven-mitted hand in front of me, like a waiter bringing a dish in a fancy restaurant. If anyone asked, I'd stop and show them the battery. I'd even get there early so I could stand there and hold the obviously deformed battery in front of me for all to see in the middle of the store.

Company policy or not, a genius with any sense would swap out the battery so the room full of potential buyers in the store would not see me dejectedly walk out of the store holding the same battery. It may cause some of them to doubt apple quality control and customer service.

BTW, get a closeup of the battery with a ruler in front of it to show how much it expanded if you're going to take this to the court of internet opinion.
 
I have to call the local mac approved repair place to see if they can file for a replacement without cost to me. If I have to pay I will then make a trip this weekend to Syracuse (about an hour one way) and go to an apple store.

That sucks. Good luck with Apple. Sounds like if you persist with the upper management you get a replacement.....hopefully.
 
So I brought it to the authorized Apple service center since they are close by and they said I was definitely entitled to a new battery since it is defective. They called me when I got home and Apple refused to give the free battery since they do not acknowledge the problem.

I am about to go into full destructive mode soon on message boards, my blogs, twitter, and even try to get the mac break weekly guys attention.

This is absolutely ridiculous. If I have time I will call them again tonight and complain. Friday I will be making the hour trip to Syracuse and have a ton of fun in the Apple store with this battery. This is beyond ridiculous really.

I had my 17" MBP battery replaced recently by applecare. It is almost out of the 3 year warranty. I called them up and they shipped me one.

Give them a call...
 
Ok, the latest.

Called apple support again, the guy this time says they can't give it to me because the replacement period ended in May for the defective battery.

I said hey man, no one told me and I didn't have a problem, this thing is less than 2 years old!

He then tells me no that was purchased in 2006, and I said maybe by mac mall but I didn't buy it until December 2007. He said if I can prove it by sending a copy of my receipt he will get me the new battery.

Progress at least! I now go to dig through my tax papers from 2007 and send that out!

One good thing is I mentioned at the repair place I went that I am looking for work and they told me they had a need for a networking guy to help the only one they have. I fortunately have a good amount of experience at it so I may come out with a new job!!!!

I will repost with my news.

I called back yesterday after emailing a copy of my receipt with date of purchase. After 20 minutes on the phone with 3 different people they finally gave in said ok. It's on it's way!
So the moral of the story is keep pestering them
 
When the Dells started exploding a couple of years ago and there ended up being a massive recall of Sony batteries that were in almost all the manufacturers laptops, I was put in charge of going through our 250 laptops for recalled serial numbers. It took a week to do and I had a headache for a week after that. Good luck with your Macbook Pro.
 
The new battery is in and the old one will be shipped back today!
I'm glad they finally did it but it shouldn't have been so difficult for something that was obviously a defect on their part.
