magic mouse scrolling locking up for a few seconds

has anyone noticed the scrolling sometimes freezes for a few seconds?

i noticed it in safari so far, after the page loads I scroll the page then leave it for a bit, and then when I try to scroll nothing happens for a few swipes

tried replacing the mouse today since this is a new iMac, same problem

thanks for any help
