Just try your best to contact him. Wait 30 days before you consider the money yours. If he doesnt try to contact in 30 days knowing money is gone from his account I wouldnt worry about it.

Very odd that this started with you being screwed, but in the end you come out way on top. I guess that is what he gets for being (insert word of choice here) :)
 
I would never consider the money yours, but you should continue to try to contact him, maybe even see if your bank can geti in touch with him. In the meantime, put the exact amount into a savings account and earn some interest on it. Sure, it'll only be a few cents, but hell, might as well right?
