Me and my GF fall under the "2%" according to AT&T...

The new AT+T data is not capped (you can use as much as you want). It will just cost you more if you use more than 2G.

Someone on this forum said he read that Sprint probably will leave it unlimited but will throttle the data rate after you exceed a certain threshold.

lol. i've been trolling on the evo 4g forums for a few weeks. it's commonly known that the 3g data cap is lifted and is TRUE unlimited so there are no overage charges. this applies to the EVO 4G ONLY with the $10 premium charge (total bill still cheaper than AT&T!) also, if u happen to live in the 4G area u can use 4G for data and the standard network for voice. now the iphone/AT&T will start to lose that exclusive feature as well.

BUT to cap it at 2gb is kind of silly.

Not at all. They probably picked it because only 2% of customers go over this cap.

If 50 customers are in the local AT&T store, then on average 1 is unhappy with the new rates. The other 49 are probably so glad that their monthly data will cost less that a couple of them add an extra line. Result, 51 happy customers (50-1+2). Net win for AT&T and the general public.

Well I was thinking about saving $10 bucks a month by getting the 2GB plan on each of our phones (I'm running Nexus One and she is on a iPhone 3G) but I better hold back on that:

USAGE-1.jpg

She is the bottom one BTW:p. I guess tethering to your computer everytime you use it along with Netflix+YouTube uses lots of data. She hasn't put internet through a provider for her home because I enabled the tethering for her.

Oh and we still have 6 days left until our next billing cycle begins.

So in summary, no thank you AT&T. We will stick with our current "unlimitted" plans that we have.

You and your girlfriend are part of the problem. Frankly AT&T could get rid of you and the entire 2% tier and survive quite well. They lose money off of people like you.

If there is a God, I pray to him that AT&T finds you for tethering and sues you (per KB) and your girlfriend on all the data you tethered.

Maybe bankruptcy will teach you kids on how to properly manage contracts.

Wow, that's harsh. Maybe chill out a bit and stop telling people how to run their lives. Have you heard of the term "unlimited" lately? Try dictionary.com, it'll change your life.

Nevermind, I just checked. All you're doing is trolling, move along

Since you clearly can't read properly, let me explain to you.

The issue at hand is not the usage. It's the mode of usage. Tethering on an iPhone is not allowed under the current plans. End of story.

I don't think I can make it much simpler but if you still don't understand, I can ask my 4 year old to try to draw it out for you.

Ok, I understand now. I'm going to head right to the AT&T store and tell them someone online told me I should ultimately pay them back for my past transgressions. I will give them a check for $5000 and beg for forgiveness.

That, or I'll just continue streaming music daily at work and hope they don't get mad at me. What's the point of paying for unlimited data and a Sirius Premium account if I'm just going to be scolded by goofs like you for actually utilizing them? But since you're not content with understanding common sense, I concede. You are the champion and you have won the internet today.

What's the point? What's the point of having a legal system? If I see somebody robbing a store, I should take vigilante justice. Because "common sense" tells me too, right?

What's the point of obeying laws? "Common sense" tells me that I shouldn't obey laws that don't make sense to me or pay taxes on services I don't use.

Your logic utterly fails.

The terms of the contract are AT&T's to make. You signed it, you obey it. If you don't see a "point" then don't sign it.

well I do expect AT&T to start cracking down on abusers on the unlimited. Your GF is volatiling her contract because it stats that tethering is not allowed.

I willing to bet AT&T will start going after those people like that and see if there is tethering killing the data on the phone.

They do "go after" people by getting them to upgrade to higher (more expensive) plans. Or they drop them as a subscriber. There's no real legal recourse, but losing the ability to use your iPhone on the network it was designed for would be a bummer.

Granted, I say this while currently being over the 5GB limit as well. The NBC.com mobile site sucked down a lot of the MBs. Next month, however, I probably won't go anywhere near.

While that math may be true every year the number of unhappy people grow percentage wise. Reason for this is just like the internet usage is increasing at home our usage of our cell phone internet has been increasing exceptionally as well. It is only a matter of time before use using 2 gigs a month is going to be common place.

You are not paying for unlimited data. You are paying for the services ATT said they would provide you in the contract you signed. Just because the services ATT said they'd provide were summarized as "unlimited data" doesn't mean you can throw out all those conditions you agreed to.

ngenerator clearly cannot understand this simple concept.

Badandy, have you ever used the Youtube app over 3G/Edge? Have you ever used Google Maps over 3G/Edge? If so you violated the same "conditions" we all agreed to.

You mind pasting which portions those are? I wouldn't think that would be against TOS; those functions are enabled by default. Tethering, on the other hand, is done with knowledge that it's not permitted and against the rules. You need to actively bypass restrictions saying you can't.

Ill admit that I dont know much about technology. With that said, how will AT&T even know if you are tethering and you arent on the new plan with it? If you have a j/b phone and you are using mywi, and you dont have tethering turned on in the settings menu, how do they know? Data is data, right? (or wrong?)

Hope they don't start enforcing payments for usage above 5 gigs as listed in their terms of service.

Prohibited and Permissible Uses: Except as may otherwise be specifically permitted or prohibited for select data plans, data sessions may be conducted only for the following purposes: (i) Internet browsing; (ii) email; and (iii) intranet access.

Youtube is not internet browsing, it is a streaming video service. Google Maps is not Internet browsing, you're downloading data for a service that is not specifically permitted by AT&T. Has AT&T shut them off, of course not.

The point is most apps violate AT&T's TOS. You even said in another post that having tethering not included was "dumb." How can you flip-flop back in forth?

I normally stay under 2GB of data, even when I tether - period. $5 savings is not going to get me to praise AT&T's new pricing scheme as you are. Just wait until you start busting that cap and you start crying that your $5 savings was BS and you want your unlimited plan back.

Fair Pricing: (per month)
200MB = $5
1GB = $10 (includes tethering)
2GB = $15 (includes tethering)
4GB = $25 (includes tethering)
unlimited = $39
unlimited + tethering = $60

Those prices I would praise AT&T for doing what is right for the consumer and for their shareholders. If you go over your cap, you are automatically bumped to the next tier. AT&T could have made a lot more money and seen as a "saint" among the cell phone providers.

AT&T had a chance to "raise the bar" and they failed!

I wouldn't think I have to obvious fact that these apps are exempted.

The TOS doesn't specifically state they are. What about the thousands of apps on the app store that violate the TOS? Those were just two examples.

This is just an example that his pulpit that he preaches from isn't as sturdy as he thinks.

Those apps don't use the same contract that we do......I'm not sure what point you are trying to make but it doesn't seem to be a very good one.

My pulpit is sturdy so far. You just said that apps break the contract. Are you serious? That's a fools argument. I'm going to go ahead and guess that using apps, which both ATT and Apple market heavily as a competitive advantage, is a permissible use. Tethering is against the rules, very plainly and unequivocally. It states as such explicitly.

Your gf is breaking her terms of service. You can justify it all you want, but you are breaching a mutually agreed contract. Sure, one person can't bring the network down, but there are more people than just your gf that are getting away with it or justifying their behavior on their minds even though it goes against something they signed. AT&T not giving you the option to tether is only a valid reason if signing that contract was not voluntary. That is simply not an excuse. I'm not trying to be some kind of stickler here, but even if 10 people in a certain coverage area behaved like your gf, they might equal 150 regular subscribers data traffic.

I don't know, a single person downloading 10Gigs a month is almost certainly causing major problems for all other data users and potentially voice calls on that specific tower.

3G networks were just not designed for that sort of data, they're not technically capable of delivering it and a reliable phone service to people. Yes, calling it "unlimited" was irresponsible on the network's part, but ultimately this sort of thing can't go on, which is why it's good AT&T are being more honest with the new plans.

Sweet! I just checked and I'm at 6.02GBs already this month! I think I'm a little over 1/2 way done with my cycle. Oops, I shouldn't have said anything, since the AT&T police are combing through this thread

So you are tethering against AT&T's policy using computers where users tend to use more data and then wonder why you're in the 2%? Because likely most of the 2% are doing things forbidden by AT&T's policies and NOT using the data through the phone. Big deal.
