No, the user claimed that MS wouldn't sue Apple as Apple has a larger market cap. I would like to know why they think the market cap would have anything to do with getting sued

The market cap issue would only hold water if Microsoft were a patent troll and looking for someone with deep pockets to get money out of. I am assuming therefore that the original claim by the author was that Microsoft is a patent troll and are merely looking for companies to extract money from.

The market cap is just a value set by investors in the company, it has no value to the company itself, it sets no opportunities, benefits, or boundaries to anyone wanting to sue a company for violations

Yes, but I'm not the one making the argument - address the person who made the original argument not me - all I was giving is my guess as to the train of thought he might have been on.
 
Oh! and when will Xerox stand up and say that they want licensing money for "graphical user interface" :D :( :p

My recollection is a bit fuzzy on this, so someone feel free to correct me.
But as I remember it, Steve Jobs was invited to ZEROX and sort of swindled them into just basically giving away their "graphical user interface" technology. I'm not even certain ZEROX had much of it patented from PARC, but I could be wrong.

As for Microsoft, they stole most if not all of their GUI tech directly from Apple and that was settled with like a $100 million infusion of cash to Apple that helped keep them afloat during the dark years.

Whether ZEROX would have any claim against Microsoft or Apple now seems unlikely. There must be some statute of limitations on patents left unprotected for decades.

No doubt though that ZEROX goes down as one of the dumbest tech companies ever. Just think how much money they COULD have made off of the PARC GUI research that they ultimately abandoned.
 
Xerox _did_ sue Apple, right in the middle of the Apple-vs-Microsoft GUI lawsuit.

Xerox felt that if anyone should profit from GUI licenses, it should be them, not Apple.

The court decided that Xerox had waited too long (about seven years after the Macintosh came out) to enter their complaint and it was dismissed.

If you've forgotten, the court also decided that almost all of Apple's claims were without merit.

The lawsuits were great sources of debate around the office watercooler.
 
I hope they kick Motorola's ass. I hate their company and their crappy phones. :mad:
