No no no, you're way off here. Your mom can buy the iPad, sell it to you, then you sell it to someone else. Then that person sells it to someone else. All the while the iPad is still sealed. All those transfer of hands does not make the iPad second hand. Generally once something is opened and used and the warranty has been registered, then it's considered "second hand" if they sell it to someone else in that condition. Second hand meaning, used.
