It's damaged, like nicks on the back bevel, nothing else just one in the upper corner, and one on the button left. Now I dont think I can take it back, exchange, or return it, since I'm sure ATT will say I damaged it! WTF man... What should I do??

contact AT&T first to see what your options are.
If they don't help you, visit or contact Apple.
 
Drawing to a premature conclusion.. and yes, AT&T or Apple will replace it. They know about it too. Some phones have that defect.
 
Call Apple. I had the same issue and was told by both AT&T and Apple that any issues of that nature (ie. damage, warranty) have to go through Apple, even if you are within the return period.
