Well since you are past the 14 days return period, you are going to have to take it to Apple. You may or may not get a refurbished replacement. It all depends on Apples stock at this point.

Apple Store - try to talk with manager. They will try to use offer you a replacement unit.
 
Apple, they will fix or give you a refurb, but those are brand new this early in the game. My refurb had an earlier build date than my launch day phone.

They are remanufactured, not refurbished. Meaning everything is new except the logic board. The Screen, casing, and battery are all new. But that's moot because for the first 2-3 months all replacements at the Genius Bar are brand new. Make an appointment or call Apple. Get a free replacement.

Att on the other hand uses refurbished phones. You can tell they are refurbished because the screen and outer casing are previously used. Only "new" refurbished phones from Att that you buy as a new device and not get as a replacement, have a new screen and casing.
 
If you bought your new iPhone at ATT, then Apple will probably tell you that you go back to ATT to get your iPhone replaced.

I've taken a defective unit in to Apple store and have got a warranty replacement despite buying from AT&T store. So be it that is was an iPhone 5 but I doubt their policy has changed.
