Well I have an 8gb Black iPhone 3g and have noticed quite a few flaws. I had the original 8gb and it was flawless, I actually wish I wouldn't have sold it....
1) The black plastic is not flush with the crome and it raised up and feels sharp the the touch.
2) 2x6 pixels are lighter than the rest on solid shades, they are all clumped together, very annoying...
3) The iphone always freezes, I have tried restoring it, recovery mode restore, 2.1 update. When it does freeze, you cant hold the home button like normal, you have to hold the power and home button and let the whole phone restart.

I am going to take it back to the AT&T store that I bought it at and exchange it. Will I have to pay the 10% restocking fee?

No, restocking fee is for returns.

Exchanges are free cause they're covered under the warranty (unless you're not under the warranty anymore).
 
I called down to the att store an they told me I can't exchange it there, only apple can.... There is no apple store here, this is some bull. I still have 5 out of the 30 day exchange period left. The sales associate contradicts what I read on att's website:
AT&T Returns Policy
AT&T values our relationship with you and offers a return policy for equipment and services purchased directly from AT&T. It may not reflect the policies of AT&T's authorized dealers or retailers. Equipment purchased from authorized dealers or retailers must be returned to those dealers or retailers.

Equipment
If the equipment you purchased directly from AT&T does not meet your expectations, simply return it either to a store or by mail within 30 days from the date the equipment was purchased or shipped. Refunds will be applied to the original payment method. Gift cards and ringtone cards are not returnable. Any rebate associated with the returned equipment will be voided.

Returns/exchanges must be like new, with all original packaging, accessories, manuals and proof of purchase. You may exchange equipment one time within the 30 day period. A re-stocking fee ($25.00 for voice-centric devices, $50.00 for data-centric devices) may be charged for equipment returned that is damaged or does not include all components (device, battery, charger, manual and software). A 10% restocking fee applies to iPhone returns. Restocking requirements and fees may vary by market or by type of equipment. See your receipt or an AT&T store for details. Equipment received through an insurance claim cannot be returned or exchanged under this policy.

Apple Branded Equipment
All sales of the original iPhone and refurbished original iPhone after July 1, 2008 are final and cannot be returned for any reason. The standard AT&T return policy applies to iPhone 3G. iPhone is not eligible for the Wireless Insurance program.
 
I took it in, they didn't have any 8gbs or black 16gbs. So I paid the 19.90 restocking fee and the extra 100 and got a nice new shiney working phone with no problems so far. :D
